Criminalizing Dissent ... again

MONDAY, 9/10--6:10 PM, 111 CENTRE ST.

Pack the NY County Civil Court, Courtroom 353, Demand Dismissal of Charges Against WCW!

This case is not just one isolated outrage: it is an attack on the right to speak out, to dissent, and to challenge the increasingly fascist direction of society.

The New York County Civil Court has allowed a lawsuit by a private phone company to proceed against World Can’t Wait–NYC for $2,000 for the removal of 10 stickers ($200 for each) from phone booths. The company claims that since the stickers refer to "The World Can’t Wait! Drive Out the Bush Regime!," WCW-NYC is strictly liable for the posting by unknown persons. The sole piece of evidence: one photo of one sticker on one phone booth.

To repeat:

Merely because a WCW-NYC sticker was found on a phone booth, the lawsuit claims WCW-NYC should pay for its removal–without the need of any proof of who actually put it there!

When was the last time the New York Times was sued for the cost of sweeping up their newspapers every time a person "littered" by leaving a copy on a bench or dropped it on the street?

Progressive grassroots organizations with limited resources depend on leaflets and other printed material to literally hand out their messages of opposition. Building opposition through mass distribution necessarily requires putting material in the hands of new people who are not known, so they can in turn disseminate the material to others.

It is not known who is really behind this suit, brought by a private phone company. But imagine the door that would be opened, and the precedent set, if the Civil Court ordered payment of the $2000!

Should the life of political dissent and opposition be bankrupt or silenced by the fear of what might be done with political materials by unknown, unfriendly, or hostile people? NO! The people should be able to express themselves on the street, and express dissenting messages--especially against such an illegitimate, immoral war and a regime demonstrably guilty of war crimes and destruction of legal rights of the people.

Penalizing political dissent with thousands of dollars in civil damages is not about who should pay for the removal of stickers-it's about political suppression. Everyone, and every organization, religious institution, union, and community group who values the right to assemble and speak out in public, including through mass distribution of material, must protest this lawsuit and the threat of financial intimidation against WCW-NYC.

Join in protesting this lawsuit and demand that it be DISMISSED! Pack the courtroom Monday, September 10, 6:10 pm, 111 Centre Street, Courtroom 353.
